1. IMPORTANT NOTICE REGARDING TEXT MESSAGE DATA

ART BÉTON (“we,” “our,” or “us”) maintains a strict mobile privacy policy. We do not share, sell, rent, or exchange our customers’ voluntarily provided registration information—including phone numbers and consent records—with affiliates, partners, or third parties for marketing, promotional, or any other purposes unrelated to the direct provision of our services. All source and consent data regarding text messaging are kept strictly confidential and used solely to facilitate communications you have explicitly requested.

2. DEFINITIONS

Personal data: Any information relating to a natural person who is identified or identifiable from such data, or from such data combined with other information in our possession.

Usage Data: Information collected automatically, generated either by the use of the Service or by the Service infrastructure itself (for example, the duration of a page visit or technical diagnostic data).

Cookies: Small text files stored on your device (computer or mobile) that allow us to recognize your browser and collect certain information in order to improve your user experience.

3. DATA COLLECTION AND USE

We collect several types of information to provide, maintain, and improve our Service, ensuring a personalized and efficient experience for our customers.

Types of data collected:

  • Personally identifiable information: full name, primary email address, mobile phone number, and physical or billing address. We also maintain a detailed record of opt-in status, including the timestamp and method of consent for SMS and email channels.
  • Technical usage data: when you visit our site, we may collect your IP address, browser type and version, pages visited, date and time of access, and unique device identifiers in order to diagnose technical issues.
  • Tracking and cookies: we use session cookies (to operate our Service), preference cookies (to remember your settings), and security cookies (to protect your data and verify your identity).
  • Customer Relationship Management (CRM) data: If you submit a request via our online forms, our quote tool, or our appointment scheduling tool, the information you provide is processed using our Customer Relationship Management (CRM) platform in order to manage your request and handle follow-up.

5. SMS MESSAGING AND COMPLIANCE

By opting into our SMS services, you agree to receive text messages related to our professional services. These may include, but are not limited to, project milestone updates, appointment reminders, customer service responses, and essential notifications regarding your account.

Verified consent: You will only receive SMS communications if you have explicitly given your consent via our web forms, specifically by checking a dedicated box that clearly describes the purpose of the messages.

User control (withdrawal): You retain full control over your communication preferences. You can cancel SMS notifications at any time by replying “STOP” to any message received. You will then receive a final confirmation message, and no further texts will be sent to you.

Data protection and integrity: We implement robust safeguards to ensure that your mobile data is never used for unsolicited marketing purposes. While we may share data with trusted service providers that offer essential support services (such as customer service platforms), these parties are contractually required to adhere to the same strict privacy standards set out in this policy.

LCAP Compliance: All our commercial electronic communications (email and SMS) comply with Canada’s Anti-Spam Legislation (CASL). Each message clearly identifies the sender — ART BÉTON. — and includes a functional unsubscribe mechanism.

6. ANALYTICS AND REMARKETING

To better understand our audience and improve our service offerings, we use specialized third-party tools.

Google Analytics: This service tracks and reports website traffic, allowing us to see how users interact with our content. Google may use this data to personalize ads within its own advertising network. You can opt out by installing the Google Analytics opt-out add-on.

Behavioral remarketing: We use Google Ads (AdWords) to display relevant ads on third-party websites after you visit our Service. This process uses cookies to optimize ad delivery based on your past interaction with our site. You can manage these settings via the page des réglages de Google Ads.

7. DATA RETENTION

We retain your personal information only for as long as necessary for the purposes for which it was collected—generally six years following the end of the business relationship—unless a longer retention period is required or permitted by law. At the end of this period, your data is securely destroyed, anonymized, or de-identified.

8. DATA TRANSFER, STORAGE, AND SECURITY

Your information, including your personal data, may be transferred to and stored on servers located outside Quebec (notably in the United States, through the use of tools such as Google Analytics and Google Ads, our customer relationship management (CRM) platform, or other tools for scheduling appointments or submitting requests), where data protection laws may differ. In accordance with Law 25, a privacy impact assessment is conducted prior to any transfer of personal information outside Quebec to ensure that the information receives protection that is adequate and equivalent to the principles applicable in Quebec. By using our Service and submitting your information, you consent to this transfer and processing within Canada.

The security of your data is a top priority. We implement robust and commercially reasonable security measures—including data encryption, secure access controls, and regular system audits—to protect your information against unauthorized access, alteration, or disclosure. However, please note that no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute protection.

9. CONFIDENTIALITY INCIDENTS

We maintain a record of any privacy incidents involving personal information in our custody. If an incident presents a risk of serious harm to a person concerned, we will notify the Commission d’access à l’information du Québec as well as the persons concerned, in accordance with the requirements of Law 25, as soon as possible following becoming aware of the incident.

10. LEGAL DISCLOSURE OF DATA

ART BÉTON may disclose your personal data in good faith if such action is deemed necessary to:

  • To comply with a valid legal obligation or government request.
  • To protect and defend intellectual property, rights, or security of ART BÉTON
  • Investigate wrongdoing or potential fraud related to the Service.
  • To ensure the personal safety of our users, employees, or the general public.
11. CONFIDENTIALITY OF MINORS

Our Service is designed for a professional audience. In accordance with Law 25, a minor under the age of 14 cannot independently consent to the processing of their personal information; such consent must be given by the holder of parental authority or guardian. We do not knowingly collect personal information from children under the age of 14 without such consent. If we become aware that a minor has provided us with personal data without the required consent, we will take immediate steps to remove that information from our servers.

12. YOUR RIGHTS AND CHOICES

You have the right to access, update, correct, or request the deletion of the personal information we hold about you, as well as the right to data portability in a structured, commonly used, and machine-readable format. You may also withdraw your consent to the processing of your data at any time.
